All access to and use of the world wide web pages of the SRU's Scotland Rugby Supporters Club (the "SRSC Website") is subject to the following terms and conditions. Entry to and any use of the SRSC Website constitutes your agreement to abide by the terms and conditions below and as amended from time to time. If you do not agree to all of the terms and conditions, please leave the SRSC Website immediately.
The following terms and conditions apply to all access to and use of the SRSC Website. Please read them carefully. You may print a copy for your records by clicking on the printer icon on your browser.
1. Parties
These Terms and Conditions of Use, and your acceptance thereof, form a contract between you ("You") and Scottish Rugby Union plc, a company incorporated in Scotland (number SC132061), having its registered office at Murrayfield, Edinburgh EH12 5PJ ("SRU").
2. Copyright

The copyright in any material on the SRSC Website is owned by SRU or used by SRU under licence and is protected by the copyright laws of the United Kingdom, international copyright treaties and all other applicable copyright and intellectual property laws. You are entitled to copy any information for your own personal use but may not remove any product identification, copyright notices or legends or other notices or proprietary restrictions from any of the material or information contained on the SRSC Website, except with the prior written consent of SRU. Any unauthorised use, downloading, retransmission, or other copying or modification of any of the content of the SRSC Website may be in breach of statutory or common law rights which could be the subject of legal action. All rights not expressly granted herein are reserved by SRU and the SRU's licensors.
3. Trade Marks
The SRU logo and the SRSC logo are trade marks of SRU which may or may not be registered in the jurisdiction from which you are accessing the SRSC Website. In addition, certain names, words, titles, phrases, logos, icons, graphics or designs to the pages of the SRSC Website may constitute trade names or unregistered trade marks of SRU or any of its affiliated companies. The display of any of the above trade names or trade marks on the SRSC Website does not imply that any licence or right has been granted to any third party in respect of the same. All other product or company names and devices, logos, icons, graphics or designs referred to on the SRSC Website are or may be trade marks of their respective owners and are exhibited only in such a manner as is intended to be for the benefit of such trade mark owners and SRU intends no infringement of such trade marks. The appearance or absence of products, services, companies, or organisations, or advertising of third parties on the SRSC Website does not imply any endorsement or non-endorsement thereof by SRU. All rights not expressly granted herein are reserved by SRU and the SRU's licensors.
4. Content (No Warranty)
The information, materials and functions contained in the SRSC Website including text, graphics, links or other items are provided on an "as is" basis. To the fullest extent permitted by applicable law, SRU disclaims all warranties, representations and undertakings whatsoever, express or implied, specifically including but not limited to warranties of satisfactory quality, fitness for a particular purpose, freedom from computer viruses and non-infringement of third parties' rights. SRU reserves the right at any time and without notice to change, amend or otherwise vary these Terms and Conditions of Use and the SRSC Website or any part thereof.
5. Data and Data Protection
All information (including but not limited to ideas, suggestions, concepts and graphics) submitted to SRU through the SRSC Website is the exclusive property of SRU and You hereby assign all rights in and to the same to SRU. Save as set out in these Terms and Conditions of Use, SRU will not be subject to any obligation of confidentiality and will be free to use the information for any purpose.
All personal data collected by SRU from the SRSC Website shall be held by SRU on a secure server and may be passed to any other associated company or to any officially approved sponsor or supplier of SRU from time to time for the purposes of processing Your application and for informing You of other offers from or relating to such companies, sponsors or suppliers from time to time. A list of such associated companies, sponsors and suppliers from time to time may be obtained by writing to SRU at the address below. By submitting information to SRU You are consenting to such use. You can obtain information on what data is held about You by contacting SRU at the address below. For certain purposes You may be asked to provide additional consent before SRU can process Your personal data.
6. Liability
SRU shall not be liable for any direct or indirect, special, incidental or consequential loss or damage whatsoever or for loss of profits, contracts, data, goodwill, work stoppage or computer failure resulting from the use of or inability to use, interruption or availability of the SRSC Website, its operation or transmission, computer viruses or otherwise in respect of the use of the SRSC Website and howsoever caused even if SRU has been advised of the possibility of such damages. SRU excludes any liability for any errors or omissions from information, materials and functions included in the SRSC Website except to the extent that such liability may not be lawfully excluded under the applicable law. To the fullest extent permitted by applicable law SRU disclaims all such liability arising from its or its employees', agents or subcontractors' negligence.
SRU is not responsible for nor shall it be liable for the contents of other websites or home pages which are linked to the SRSC Website. SRU shall have no liability in respect of material hyperlinked to the SRSC Website which may be misleading, inaccurate, defamatory, threatening or obscene or otherwise not in accordance with such regulations as may be from time to time in force. The provision by SRU of a link to another website does not constitute any authorisation by SRU to You to access materials held at that location, nor is it evidence of any endorsement or non-endorsement by SRU of the material held there.
If You wish to provide a link to the SRSC Website this must be to the homepage which is currently at www.tunnelpass.org. You are not permitted to frame or link to any other page of the SRSC Website without the prior written consent of SRU. You are not permitted to use any robot, spider, other automatic device or manual process to monitor or copy the SRSC Website or the content expressed herein.
SRU operates the SRSC Website from Edinburgh, Scotland and makes no representation that the information contained on the SRSC Website is appropriate or available for use in other locations outside the United Kingdom.
8. Governing Law and Jurisdiction
These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of Scotland. You agree to submit to the exclusive jurisdiction of the Scottish Courts. You are responsible for compliance with any applicable laws of the country from which you are accessing the SRSC Website.
